Mediation is a form of structured negotiation in which an impartial mediator helps the disputants to reach an agreed outcome, often by clarifying the interests underlying their positions and seeking ways by which those interests may be met legitimately. By meeting  jointly and separately with the parties and their lawyers (treating all private communications as confidential), the mediator often sees room for agreement where none might be apparent.

Our expert mediators routinely suggest possible solutions designed to meet the parties’ interests and, where appropriate, test the parties’ and their lawyers’ views as to their prospects of success before a court or tribunal if the dispute cannot be resolved by agreement.

If asked by all parties and where it may be helpful, our mediators will also express their own views as to likely court or tribunal outcomes.
